Photography Agreement Information

This page is informational only. Rachel reviews your session request, then prepares an individual agreement with your final session details and pricing.

You do not fill in pricing or business terms. You receive a private link by email to review and accept your personalized agreement.

These draft reference sections show Rachel’s standard agreement structure; final client-specific details are inserted into the private agreement after review and finalization.

01.Session Information

The Photographer agrees to provide a Portrait Session under the following conditions:

Session Date: the date specified in your personalized agreement

Session Time: the agreed session time

Location: the agreed session location

The Photographer will provide professional photography services and deliver a curated gallery of edited digital images from the session.

02.Payment

The total cost of the photography session is the amount specified in your personalized agreement.

Payment terms:

  • A non-refundable retainer of the amount specified in your personalized agreement is required to reserve the session date.
  • The remaining balance is due the day before the session date (specified in your personalized agreement).
  • If full payment is not received before the session, the Photographer reserves the right to cancel the session.

Payments may be made via:

  • Payment methods specified by Rachel in your personalized agreement

The session date is not reserved until the retainer and signed agreement are received.

03.Cancellations & Rescheduling

Client Cancellation

If the Client cancels the session:

  • The retainer is non-refundable.
  • Any additional payments made beyond the retainer may be refunded at the Photographer’s discretion.

Rescheduling

Clients may reschedule the session once with at least 48 hours notice.

Rescheduling requests made within 48 hours of the session may result in loss of the retainer.

Photographer Cancellation

If the Photographer must cancel due to illness, emergency, or unforeseen circumstances:

  • The session will be rescheduled, or
  • All payments will be refunded.

04.Weather Policy

Outdoor sessions may be rescheduled due to:

  • Rain
  • Severe wind
  • Unsafe weather conditions

The Photographer will determine if weather conditions require rescheduling.

05.Image Delivery

The Photographer will deliver the agreed number of edited digital images through an online gallery within a week after the session.

The gallery may include:

  • High-resolution downloads
  • Personal-use print rights

RAW or unedited images will not be delivered.

The Photographer selects the final delivered images.

06.Copyright Ownership

All images created by the Photographer remain the exclusive intellectual property of the Photographer and are protected under United States Copyright Law.

The Photographer retains 100% copyright ownership of all photographs.

The Client does not receive copyright ownership of any images.

07.Client Usage License (Personal Use)

The Photographer grants the Client a non-exclusive, non-transferable personal-use license to:

  • Share images on social media
  • Print images for personal use
  • Share images with family and friends

The Client may not:

  • Sell images
  • Submit images to publications
  • Enter images into contests
  • Provide images to vendors or brands

without written permission from the Photographer.

08.Photographer Usage Rights / Model Release

The Client grants the Photographer irrevocable permission to use images from the session for purposes including but not limited to:

  • Portfolio display
  • Website use
  • Social media
  • Studio samples
  • Advertising and marketing
  • Publications
  • Photography competitions

The Client understands that images may be used without additional compensation.

09.Image Alteration Policy (NO FILTERS)

To preserve the artistic integrity of the Photographer’s work:

The Client agrees not to alter the images in any way.

This includes but is not limited to:

  • Adding Instagram filters
  • Applying presets
  • Changing colors or tones
  • Using TikTok, Snapchat, or other app filters
  • AI editing tools

Images must be shared exactly as delivered by the Photographer.

Violation of this clause may require the Client to remove the altered image from public platforms.

10.Editing Style

The Client acknowledges that they are familiar with the Photographer’s portfolio and editing style.

Editing choices including:

  • color grading
  • retouching
  • cropping
  • artistic adjustments

are made at the Photographer’s professional discretion.

11.Photographer Liability

The Photographer will take all reasonable care during the session and image processing.

However, in the unlikely event of:

  • equipment failure
  • memory card corruption
  • loss of images
  • acts of nature
  • emergency

the Photographer’s liability is limited to a full refund of all payments received.

The Photographer shall not be responsible for missed images due to:

  • late arrival
  • lack of cooperation
  • interference from guests
  • wardrobe malfunctions
  • environmental restrictions

12.Safe Environment

The Photographer reserves the right to end the session if:

  • the environment becomes unsafe
  • harassment or inappropriate behavior occurs
  • illegal activity occurs

No refunds will be issued in these situations.

13.Agreement

By signing below, both parties confirm they have read, understood, and agree to the terms of this agreement.
